SSKM-SSU(UK) OFFICIAL STATEMENTS AGAINST KHAIRY JAMALUDDIN

Greetings to all the people of the Sovereign States of Sabah and Sarawak. I am Doris Jones, representing the group of Sabah Sarawak Keluar Malaysia (SSKM), which operates under the patronage of Sabah Sarawak Union (SSU) - UK, a Non-Governmental Organisation (NGO) LEGALLY registered under Legal Affairs Council United Kingdom of Great Britain and Northern Ireland (UK), would like to make an official statement referring to the statement made by Khairy Jamaluddin Abu Bakar, Minister of Youth and Sports Malaysia, during his visit to Sarawak on November 23rd 2014. In an article published by an online news portal, the Malaysian Insider, he claimed that “Pemuda BN sedia tentang pihak manipulasi Perjanjian Malaysia" (BN Youth ready to go against anyone manipulating the Malaysian Agreement).

Among his arguments, he (Khairy) stated that “The Youth of Barisan Nasional (BN) are committed to uphold the Malaysia Agreement 1963 to avoid any attempt of manipulation (of facts), especially in the coming Sarawak State Election.” [1]. He has also added that “his officers will be equipped with in-depth understanding pertaining to the agreement.” [2].

In the statement, he said that they are aiming for "an attempt to fend off those who are trying to cause dissatisfaction among the people of Sabah and Sarawak" [3]. In addition, he said, "we are committed to the agreements made for the establishment of Malaysia. Malaysia was established by Peninsular Malaysia (Malaya), Sabah and Sarawak. Rather than Sabah and Sarawak joined Malaysia" [4]. And later in his short argument he states that "We are aware and we will enforce the agreement and any agreement under the theme of the Malaysian Federation" [5].

First of all [1], I would like to thank Khairy Jamaluddin Abu Bakar for having an intention to stand up for the Malaysia Agreement 1963. Therefore, I have some questions for you and I am expecting an honest answer. Is the current Federal Constitution of Malaysia today, is a whole new constitution amended in 16th September 1963, or is it the altered and modified version of the Constitution of the Federation of Malaya (Persekutuan Tanah Melayu) amended in 31st August 1957? The Federation of Malaysia was established in 16th September 1963, thus is it appropriate to use the 1948 Sedition Act in the Malaysian Federation, especially on the people of Sabah and Sarawak? Have “Malaysia” ever even gain an Independence? How many years has it been since the establishment of the Federation of Malaysia?

Secondly [2], your officers will be equipped with understanding pertaining to the agreement, and in what context will that understanding be? Will it be in the context of understanding that Sabah and Sarawak have merely agreed to form the federation of Malaysia by becoming at the same level of the other 11 states in the federation of Malaya, or will it be as equal partners (of countries) in the formation of the Federation of Malaysia? If you would say that, in fact Sabah and Sarawak are the 12th and 13th state in the federation at the time of the agreement, were there any representatives from the other 11 states of Malaya to sign the Malaysia Agreement in 9th July 1963? Or was it only one single representative for the whole of Malaya who signed the agreement?

Third [3], I admit that I am fully responsible in provoking the feeling of dissatisfaction among the people of Sabah and Sarawak because of what we are claiming for are indeed our birth right. Do you expect us to rejoice when our rights agreed upon in the Malaysia Agreement are not being respected and are being violated? The uneasiness and dissatisfaction occur when we and other NGOs educate the people with the truth about their history supported by facts which have been hidden from them with malicious intentions. Should I tell them to “rejoice” after knowing about the rights they supposed to have in the 1963 agreement that are supposed to be honoured are being violated?

Fourth [4], statements such as these have been heard for 51 years including this year. However, statements are mere statements which never ends, and are only being uttered by words but never been followed by action. The Federation of Malaysia was formed by Four Independent Countries – The State of Sabah, the State of Sarawak, the State of Singapore and the Federation of Malaya (Persekutuan Tanah Melayu). The question is, where did the government of Federation of Malaya have gone to today? What about the definition of the word “federation” in the constitution of Malaysian Federation? Is it referring to the definition accepted in 16th September 1963, or is it the definition of “federation” used in the formation of Malaya in 31st August 1957?

Fifth [5], if truthfully you are aware and you are dedicated to stand up for this agreement, would you use your capacity as a minister and member of parliament in the government of Malaysian Federation to bring up this motion to the parliament next year so that the agreement can be reviewed? This is because, the agreement that we have today still consist of the clause that Singapore is still a part of the federation of Malaysia. We are well aware that Singapore quit the federation (rather than being sacked). By right, a Constitution of the Federation of Malaysia is to be formed by highlighting the membership of 4 (now 3) governments of within the federation rather than 14 governments like what we have today. Can all of this be done through your guarantee and action as a minister in the Federation of Malaysia?

All answers to these questions will be considered as the full answer of the government of Federation of Malaysia as you are representing the government. Therefore, any statements in response to this from you should be through your representation of the government and not your individual capacity.
